need legal advice please!!!!

i need some advice on what the laws are in floyd county virginia? i have gotten in a situation with bobby johns pres of 311 speedway inc. and 311 holdings inc.

i recieved a letter stating that being things didnt work out for me at 311 that bobby johns is holding all my posessions in this world untill i pay 311 back $1800 for moving me here to n.c.

now i have talked to stokes county authorities and in n.c. it is larceny to hold someones property and not grant them posession.i have some things at the track in the apartment upstairs and every piece of construction equipment i own is in floyd county virginia.

what would like to know are the laws of virginia commonwealth on these principals.

i had no contract or verbally that if things didnt work out i would have to pay 311 back for any move.
now by n.c. laws what has taken place is totally illegal and if over a certain amount which i think its 5 grand is a felony charge of grand larceny.

now i need to know about the laws in virginia,because there is no telling how much my equipment is worth in virginia.

i also am unable to work because he has my companys equipment held hostage and i want to see if i can backcharge him for these days my company has been unable to do work in this area.

im sorry i have to put this on here but i need some help in finding what is legal and how far i have to carry this out.i mean everything i own this man has and wont let me get it back.so if anyone has any advice please answer my few questions.

I am sure if you check online, you will find a number or 2 for attorneys in that area that can give you free legal advice. A professional legal advice is better then second hand guesses. Better to be safe then sorry! Good luck in your search

:icon_agreed: Nah, seriously though, if you don't find what you need on here, I would just contact the authorities in VA. Also, you might want to talk to an attorney up there. Most of them at least give you a free consultation. You know him better than the rest of us and probably know how far he's willing to go with this, so the best advice I have for you is it's better to be overprepared than unprepared. I hate this is happening to you and hope everything gets worked out.

This is pretty much common sense any where you live. You are legally an adult, and unless there is no contract written on paper, he legally has no right to hold your property. I would think this would be considered misdemeanor larceny of personal property, depending on the value of the property.

Hey Robbie I can't believe what your Dad has done to you. This just shows how big of a jacka$$ the man is. We have only been dealing with this man for about a year and a half but you've dealt with this your whole life. My heart goes out to you buddy. I don't know if there are different laws up there, but from what I can find out here where we live, unless there was some kind of agreement on moving costs, he has no legal right to hold your things......Good Luck with this......

again it is overwhelming for all the offers to help,i truly appreciate it and i got a call into jackie to let her know my intentions tommorrow so we will see what the true head of 311 says and does.

but on another note ,hey i did get a job at duke working in the mill for a construction co. so my little wheels are starting to roll.man am i glad of that cause its been stagnent here for a week.

im staying with mrs. linda coleman,she works at the restaraunt and her grandson races the #12 in jr. u cars,alan caudle.she has been so nice to me,well all of them really.i am thankfull!

like i said i do thank you nice folks for your offers and help,that is what true america is about.its hard to find good people now in these times but i can say one thing there are some truly good people in and around this area and i cant say it enough thanks!!!!!

Robby hate to see you having such a bad relationship with your father. But the best way to deal with him legally would be to invole a lawyer. Maybe if you can tie him up in courts with some legal fees he will end up losing his track. Could be he wants to sell all your valuble items to help him keep his track. I really don't see how Linda has stayed with him for so long. She is such a nice person and about the only one that he has not ran off. Just wish you luck and hate to say it because its your dad but I think we will all be glad to see him gone.

Everyone, here's a couple of ideas.

1. We have all seen the ribbons for the troops, breast cancer and all the other good causes. Maybe we can all find a color ribbon and wear it each week in support of Robby.

2. We can even go one further some one could be outside the ticket booth (until Bobby kicks them out) and collect donations to help Robby. I know we all don't want to give into Bobby's blackmail but I believe we could all collect up enough funds to pay the $1800 and get Robby's equipment and other personal posessions back while he goes through the LEGAL channels.

What does every one think?

I don't feel a full boycott would work cause we all know he would just cancel the races and probably try to keep everyones money stating some BULL S!@# reasons.

Well, I'm hoping after all this has come to light, everyone else will realize what kind of person we have running 311. I'm all for helping Robby anyway we can! That being said, a boycott is definitely NOT the answer. Guys, this is OUR track. By "our", I mean all of the fans, crew, staff, and drivers who've been coming over the years. We were here long before he came along, and hopefully we'll be here when he's gone. I know, we all hate giving over our money to him every weekend, but we still need to come out and support our drivers who come from all over the place to do what they love...race hard and give us a good show. We just need to try to deal with the owner until someone can come up with the money to pay him off and get him outta there or if he gets himself in so much legal trouble, he loses the track. It's up to us to keep our track going and well, I'm still gonna spend my money there every weekend I get to go. :Kool:

yall know one other thing that upsets me is the fact i saved an old racing jacket of his that was about 30 yrs old and gave it to him when i came up here and he couldnt believe i saved it all these years and then a couple of days ago he threw all my clothes outside and then later he threw them in the dumpster.thats about the lowdowndest thing he could have done,but thats ok someone brought me pictures of it all.

and then this afternoon he told linda that i was banned and could never race at 311.she said well he cant because you got his racing stuff!!!!

Maybe pointing out these bad business practices to the bankruptcy judge from his bankruptcy case last year might be in order too.If im not mistaken ...and I may be...He had to go to court with a business plan to keep the track this year.This kind of business can show the next bankruptcy judge the type of bussinessman he is really dealing with.

well i did get in touch with the floyd magistrate and it looks like i have to file a warrant of debtinue.and basically i have to go to court and let a judge decide who has the right to my belongings.but by what i described and its all the truth,they said that there isnt a judge in va. that would side with him.
dnswwood thank you and its hard not to go and stoop to his level but im trying real hard.i did go to the restaraunt to confront him today but lucky for him he had already left.i tried to call him several times today to ask for my stuff back and he just hung up on me and then wouldnt answer the phone when i called back.
folks he is getting word from someone about me posting on here but i dont care they can go tell it anyway they want too,but i will tell everyone in the world i meet to stay away from this crooked man i have as a father.i know some folks say,how can i go on here and talk about my dad this way.well its because he is crooked and if my situation dont prove it then they are as crooked as he is.

Just call or go to the local Police Department and make a citizens request to have an officer escort you to the facility for you to remove your belongings. Your father will have to seek his money through the courts. Not by witholding your belongings without a court order. If they give you the ho-hum, just ask them to put it in writing why they won't. They will give you the assistance you need.

thanks man i will try that as well.i have been told that he couldnt hold my posessions but i have wore out the phone with some attorneys but along with what you said i should be able to get my stuff by this week.i hope i can cause i start working the night shift 7 days at 12 hrs a day for the next 16 weeks.

well folks the wheels of justice sure are slow,havent heard a word back from virginia sherrifs dept. i guess they dont want to get involved.im planning on sunday to get them to escort me to his house and load my stuff up and be done with him forever.

i start tonight at duke power at the belews plant pipefitting.couldnt go in as a welder because he has all my welding tools.so i borrowed some wrenches and a box and some tools to fit with.

anyone needing a job call shaw construction in kernersville.they need some welders and fitters and electricians.i also think they are hiring millwrights.night shift is working 10's then supposedly going to 7/12's. we are making $22/$65.the perdeium of 65 is for 50 miles or greater from the plant.hard to be able to race but at least i can afford an attorney now!!!!! ha!ha!ha! yall have a good day!!!!!!!

well another page in the saga of the circus master of a father i have.i went to the restaraunt thursday and had a civil conversation with him and told him i planned on getting my stuff sat and sun.
he shook my hand and said he still loved me but i think it was only because of the company that was in there because he didnt want folks to see his side i see.well sat i worked late and made it to the track to see the races.
then today i went to va. to get my things and he was off riding horses with jackie.
so i just loaded my daughters 4 wheeler and my welding trailer up and was waiting till he came back so he couldnt say i stole anything.well wouldnt you know it he is claiming i still owe him $1800 bucks for using him to move here.
he said jaybird needs a better lawyer and he and jackie will wind up with 311 and for me to quit posting this stuff on the internet.well i guess im in trouble now!!! ha!ha!ha!
i will tell this untill it ends because when he spreads crap there is only one or two listening.when i talk with folks on here there are thousands.
anyway he said he was letting me take what i loaded by myself but i couldnt come back without some money.
well i tried to go up his driveway but its a straight up hill and he wasnt going to help me till i tore up the driveway of rocks.he said if i couldnt get up the hill then i would have to leave my trailer.so after a few trys i had made ruts,and then he got the tractor and pushed me behind the trailer to get up the hill.
i tell you if there is one coldhearted man in this world he is it.
he also said mr. mike johnson had lost alot of respect for me for posting this stuff on here.well i ask mr. johnson? what would you do if you were in my shoes?
i havent disrespected one person up here since i have been here but one and that is the one that has no respect for noone and that is bobby johns.(the one from lakeland and not miami!)
i noticed he didnt mind using my equipment while its been there.my torches were nowhere to be found and my stuff that was under his open barn had the tarp off of it and my pictures of my racecars and my daughter have been ruined because it rained on them.
i also noticed thatmy stuff had been gone through and just throwed around.the tarp that was on my stuff was now on his old panelwagon outside and my things holding it down.i dont know how much is ruined and how much i will recover but there is one thing for sure,he will pay for what he did and has done to me.
i dont post this for any sympathy or donations but for the simple fact,i want folks to know what and how the pres. of 311 speedway and 311 holdings is.

i sure enjoyed helping mr. gary east on his car but he had a driveshaft break in half and beat the cockpit of his car up.
